Dear Judge Prosser:

 I am writing because I am shocked and embarrassed at what is happening regarding the Miller/Jenkins case.  It appears that an activist judge in Vermont is pushing Vermont law on Virginia citizens.

I would like to respectfully remind you of what happened in Virginia in the fall of 2006.  Virginia voters easily approved a state constitutional ban on same-sex marriage, making the state one of nearly two dozen to pass such measures. 

This amendment states: That only a union between one man and one woman may be a marriage valid in or recognized by this Commonwealth and its political subdivisions. This Commonwealth and its political subdivisions shall not create or recognize a legal status for relationships of unmarried individuals that intends to approximate the design, qualities, significance, or effects of marriage. Nor shall this Commonwealth or its political subdivisions create or recognize another union, partnership, or other legal status to which is assigned the rights, benefits, obligations, qualities, or effects of marriage.

In the case of Miller vs. Jenkins that is currently in your court, you are recognizing a same-sex union.  Furthermore, the Virginia Constitution states in Article 1, Section 2 that “all power is vested in, and consequently derived from, the people, that magistrates are their trustees and servants, and at all times amenable to them.” As a judge, you are a trustee and servant of the people; it is your duty to implement the will of the people of Virginia – not the will of the people of Vermont.  There has been an unwillingness of your court to take a stand on this issue. You have not been placed in this position of leadership to wash your hands of the situation especially knowing that you have the personal Opinion of Virginia Supreme Court Chief Justice Hassell, which says, “I have serious concerns about the Court of Appeals’ opinion in the former appeal Miller-Jenkins v. Miller-Jenkins. I do not believe that this decision was correctly decided.”  Your original ruling, based upon the Virginia Marriage Affirmation Act, states that Lisa is the only parent of Isabella, Virginia cannot recognize any court order arising from a Vermont court pertaining to this situation, and that Janet could have no rights other than those of a friend.

It is time for the courts in Virginia to do what the will of the people voted upon, specifically, not to recognize any unions other than those between one man and one woman.  I urge you to reconsider your current, 2008, ruling based upon the merits of this case: Virginia State Sovereignty and basic Parental Rights.

I just wanted to personally praise God on the ruling of sole physical and legal custody of Isabella to me.  I know God was in control of that decision.  He had total victory for what He intended to happen.  I praise Him and am thankful that He is faithful and just for His children.  Not only am I His child but so is Isabella.  He did what He felt best for Isabella- and that was to keep her with me.  

As I was coming over to a friend’s house today after church I heard on the radio a preacher quoting scripture from Esther.  Not a coincidence since for the last two weeks the book of Esther has been the topic of family devotions.  We have studied Esther, we have prayed as Esther had, we acted as both Esther and Mordecai had acted when faced with opposition.  The pastor today on the radio relayed the message of Mordecai and how he said to Esther “How do you know you were not created for such a time as this?”  The pastor went on to say that we as Christians have a time created for us that we are to stand for the Lord.  This is my time and I know that He will give me the strength and the victory through Him- not only for me but for my daughter.

1. The civil union is dissolved.  Decree nisi to become absolute in 90 days.
2.  Lisa Miller shall pay Janet Jenkins in the amount of $2, 766.50. Janet Jenkins shall pay Lisa Miller one-half of the net proceeds of the timeshare or one-half of the agreed- upon value.
3. Sole physical and legal custody of the minor child IMJ is awarded to Lisa Miller.  This is subject to parenting time with Janet Jenkins as follows:
   1. Janet will have initial parenting time on two Saturdays: June 30 and July 7, from 9:00a.m. through 5:00p.m., in Virginia.
   2. Janet will have two weekends with IMJ: July 13-15 and July 27-29 from 5:00p.m. Friday through 9:00a.m. on Sunday, in Virginia.
   3. Janet will have one week from August 19 through August 25 in Vermont with IMJ.  Lisa will transport IMJ to Vermont to arrive by 8:00p.m. on the 19^th; Janet will transport IMJ back to Virginia to arrive by 8:00p.m. on August 25. 
   4. After August 25, Janet will have parenting time every other weekend, to alternate between Virginia and Vermont. This will be from 5:00p.m. Friday until 5:00p.m. Sunday.  Transportation will be split between the parties.
   5. IMJ will spend Thanksgiving vacation with Janet in Vermont and Christmas vacation with Lisa in Virginia. Thanksgiving and Christmas vacations will be alternated on a yearly basis.
   6. Summer vacation will be allocated at a later date.

The purpose of this specific initial schedule is to facilitate reunification between IMJ and Janet. The Court has suggested that the parties utilize an outside facilitator to determine a long-term parenting time schedule, but is not aware of what services are available to the parties in Virginia. It is suggested that the parties make use of such a service if available and submit a stipulated order on allocation of parenting time. The above schedule is ordered in the interim.” 

The Judge then signed and dated the order.   

Dear Friends,                                                                                       June 22, 2007 

Many of you have asked me for an update, especially since you read about the latest ruling from Vermont, which came out nationally in the media on Tuesday June 19, 2007.  A lot has happened since my last update. I will try to go in chronological order.  

First, however, I want to thank every one for your prayers, thoughts, and encouragement.   Please know that God is still in control and He will answer our prayers in His time and in our best interest.  I still believe that God has His hand in my legal case.  It is obvious to me that God had His hand in the latest ruling. Isabella remains in my full legal and physical care (custody) despite what Janet asked for – transfer of full legal and physical custody to her.  Praise God! 

Despite this fact, I feel that God is still using my legal case to show us what our nation is becoming when we deviate from God’s plan and purpose for our lives.  Yes, victory was won by God for Isabella in that she remains in my care.  However, victory is not complete until Virginia rules in favor of our pro-family laws which clearly state that civil unions, gay marriages or any contractual agreement arising from a relationship that purports same-sex unions are not acceptable OR ENFORCEABLE in the state of Virginia.  We must not deviate from what God has in mind for my legal case.  

Why am I saying this?  Because I have received much feedback from people who know me either personally or professionally and the consensus is that my legal case is over.  It is not over.  Virginia must be held accountable for overruling Judge Prosser’s legally sound decision in 2004, stating that Virginia and not Vermont has jurisdiction and that Virginia does not recognize civil unions.  Therefore, Janet’s requests to enforce the Vermont ruling in our state is void.  Unfortunately, the Virginia Appellate court overruled Judge Prosser’s decision and I am forced to give Janet visitation rights or as Vermont calls them “parenting time.”   If I don’t follow the Vermont court order I may lose custody of Isabella  as well as incur other sanctions because Virginia is not standing by her laws and protecting us as Virginia citizens.  

The following is an outline of the events in the last three weeks.  Please keep in mind that tomorrow I will post experts from the legal filings that Janet filed against me in the Vermont court on my blog onlyonemommy.com.   I will also post experts from the Judge’s final ruling on my blog.   The following is the outline

1.  In May 2007, Janet files a contempt (sanctions request)  charge against me stating that I agreed to a Mother’s day visit between her and Isabella.  I did not.  A week later, she files an amended version of her first filing and stated I agreed to this visit in private with her during the first scheduled visitation.  Again, I did not agree to any visit.  She asked for sanctions against me including travel expenses for the missed visit.  We replied with a personal affidavit from two people including myself “swearing” that I never agreed to a visit between Janet and Isabella during or on Mother’s day weekend.   Emails and other documentation were included in our affidavits, which clearly proved beyond any doubt that I never agreed to a visit. 

       2.   On May 26, 2007, Janet and Isabella had another visit.  I, including a third party, was present.  We both hung back though and allowed Janet to interact with Isabella.  Isabella started having social and emotional problems after this visit.   Immediately after the visit Isabella told me tidbits of the conversations and actions that went on between Janet and her and was very distressed as to why Janet treated her in the manner she was treated.  We filed an affidavit along with one other person to Judge Cohen in Vermont detailing the visit and certain events that took place.  The Judge so far has ignored our affidavit (and apparently will continue to do so since he has since ruled his final ruling).   Isabella is very distressed. 

     3.   On June 5, 2007, Janet filed a “Request for Evidentiary Hearing on Sanctions” asking Judge Cohen in Vermont to sanction me for information that I posted on my blog, onlyonemommy.com.   She submitted two documents. The first document being a three page document quoting and misquoting pieces of information from prayer letters and postings that were found on my blog.  The second document was her “Request to admit and Interrogatory” where she asked me to admit or deny 28 facts within the next 30 days.  This document was filed to encourage Judge Cohen to rule for a transfer of custody of Isabella from me to Janet.       Both documents falsely accused me of not being able to foster a positive relationship with Janet because of my religious beliefs.  She wishes to sanction me for some of my  following beliefs:                               

            a) “God gave Isabella to me by forming her in my              womb”           

b) “God’s order is that marriage means a union between one

 man and one woman, a child can not have two mothers, Ms.

Jenkins is not Isabella’s parent, and Ms. Miller is commanded  to follow God’s plan”  

c) “If Ms. Jenkins is granted custody of Isabella, no Christian  will be safe to raise his/her child as they see fit” 

          d) ”God has a plan and purpose for Isabella’s life”      

 4.    On June 11, 2007, Janet submitted to the Vermont court a “Reply to Second Notice Concerning Visitation.”  This is a 5 page document where again she takes experts from my blog and claims that I will deny any court order from Judge Cohen and that a transfer of custody is the only way for Judge Cohen to rule.  In this document Janet tries to discredit my and the other person’s affidavit regarding the May 26, 2007, visit between her and Isabella.  She ends her document with the following:    

         “Ms. Miller is determined to stymie Isabella’s relationship with   Ms. Jenkins regardless of what this Honorable Court says. As she wrote on her blog last month: A sin is a sin. Jesus tells many people to ‘sin not’ or ‘to go and sin no more’…Jesus goes on to say in I Timothy 1:9-10 the following: ‘realizing the fact that law is not made for a righteous person, but for those who are lawless and rebellious, for the ungodly and sinners, for the unholy and profane, for those who kill their fathers or mothers, for murderers, and immoral men and homosexuals and kidnappers, and liars and perjurers, and whatever else is contrary to sound teaching” … From this passage you can also surmise who is a sinner”.     

This expert from my blog was taken from the post “Hate the sin, love the sinner”.  I praised God that they ended a court filing with God’s word!    

     5.   On June 15, 2007, we replied via a court filing to their interrogatories and other documents.  Praise God that we were able to answer each question Biblically and with even more accuracy than what I had written in my blog.  God is gracious in giving us opportunities to witness.  However, unbeknownst to us the Judge in Vermont had already made his final ruling- not taking into consideration any of our replies or affidavits.   Again though, I praise God because our reply, which is full of God’s word, is a court document for all to read. Perhaps someone will be saved through this ordeal. 

   6.  On June 16, 2007, I learned of Judge Cohen’s final ruling.    For word count sake of this prayer letter, I will post Judge Cohen’s final ruling on my blog.   I will post the final ruling just regarding the visitation schedule by Saturday June 23, 2007.  In open admission, I have had an emotional week and ask for your continued prayers.  

Please also pray for the following:

1.    Isabella must visit Janet unsupervised with me not being present on June 30, 2007 from 9:00a.m. until 5:00p.m.   Isabella is very upset and fearful about this visit.   She has asked me to be there and does not understand why I am not able to be present.  Please pray for her safety, her comfort and for her to experience peace during that visit.  Never in her life has she just been dropped off with someone she does not know or where she has specifically requested that I be with her.  This is the first of many visits that are to occur according to the Vermont ruling.  Overnight visits are to begin in July- with two consecutive overnights per visit!    

2.    Guidance for me on how to prepare her for this visit.   She is so upset that  she has to visit Janet that she cries, screams and runs from me every time we talk about the visit.   Praise God I found a therapist who is knowledgeable with what Isabella is going through emotionally. This person is also knowledgeable with issues that arise from Janet’s visits, which may likely create additional stress in Isabella’s life.    

3.   Wisdom for all attorneys involved in my case.      

4.    For the Virginia Supreme Court to rule in my favor.  My case has yet to be ruled on by the Virginia Supreme Court.  Please pray for the judges that they will stand by Virginia State Law.     

5.  For the U.S. Supreme Court to see the importance of my legal case and to take it when the time is right.  To take it and to rule in our favor- for state law to stand.  Isabella was born in Virginia under VA laws and is domiciled in Virginia and needs to be protected by VA law.     

6.   For God to answer Isabella’s prayers so she may continue to see, feel and  know God is with her.

This week’s topic is the following:

 HATE THE SIN, LOVE THE SINNER 

I have been asked by many people what hating the sin and loving the sinner means. In court, I was accused of hating the sinner because I hate the sin.   In my daily life, I have been asked by women who identify themselves as homosexuals how I can “hate the sin yet love the sinner”.  Please as you are reading this post keep in mind that I am not a Bible scholar nor am I attempting “to teach” you.  Rather, I am sharing the thoughts that God has laid on my heart.

 I encourage you to learn more about this topic by reading your Bible and by talking with your Pastor.  If you do not own a Bible or even would like to delve more into this topic by reading more passages and learning more verses etc I encourage you download for FREE a copy of www.e-sword.net. First, I feel that I must define the words “sin” and “sinner,” “hate” and “love”- this way we will both “be on the same page.”  Many times, I discover that we as humans misunderstand one another because we both have a different interpretation of the same word, situation, and or topic being discussed. A sin is any act, thought, or deed that is in direct violation of God’s word (law).   In other words, a sin can be anything that separates us from God and keeps us from living with Him in eternity.   A sin is a sin is a sin.  Jesus tells many people to “sin not” or “to go and sin no more.”  By looking at these peoples lives, we can determine what sin is.  In addition, Jesus tells us outright what sin is.  For example, He speaks through Peter in 2 Peter 2:14 and says “having eyes full of adultery that never cease from sin, enticing unstable souls, having a heart trained in greed, accursed children;”  It is clear from this verse what Jesus considers sin- adultery, greed, and people who influence others for evil and not for good. 

Jesus goes on to say in I Timothy 1:9-10 the following:

”realizing the fact that law is not made for a righteous person, but for those who are lawless and rebellious, for the ungodly and sinners, for the unholy and profane, for those who kill their fathers or mothers, for murderers, and immoral men and homosexuals and kidnappers, and liars and perjurers, and whatever else is contrary to sound teaching”   

       From this passage, you can also surmise who is a sinner.  A sinner is a person who commits the sin- breaks the law.  Therefore, a sin and a sinner are not the same.  A sinner is the “murderer”, the “immoral men and homosexuals”, “the kidnappers”, and “the liars and perjurers”    Whereas the sin is the killing (murdering), the act of homosexuality which is the giving “over to degrading passions; for their women exchanged the natural functions for that which is unnatural, and in the same way the men abandoned the natural function of the woman and burned in their desire toward one another, men with men committing indecent acts…” (Romans 1:26-27), and the actual taking of another person and the list goes on.    

            Again, it is very clear to see what Jesus considers sin… In this passage, one can also see the types of sin and how Jesus views them all the same- that is a sin is a sin is a sin.  We must also remember that there is “no, not one who is righteous.”(Romans 3:10).   Thus, God’s law is for everyone.

Let us take one last look at what the words “sin” and the “sinner” are.  Jesus speaks numerous times on what will keep us out of heaven- living with Him.   Two such passages which the Lord directed me to when I was deciding to “leave sin and follow Jesus” and which I feel clearly defines the words sin and sinner are I Corinthians 6:9-10 and Psalms 11:1-5.   The first passage is I Corinthians 6:9-10: 

“Or do you not know that the unrighteous will not inherit the

kingdom of
God”

These particular passage paralyzed me- stopped me in my tracks.  I became so fearful that I was going to hell that I turned away from God (at that time, I did not have anyone in my life who was willing to “love the sinner”).  I did not read further.  Instead, I turned deeper in sin.  I encourage you though to continue reading.  Read on though this passage and find out what can be done so that you may enter the

kingdom of
God.

Verse 11 tells me “Such were some of you; but you were washed, but you were sanctified, but you were justified in the name of the Lord Jesus Christ and in the Spirit of our God.”  It is these people- such were some of you – who will enter the kingdom of heaven.  All is not lost.  Accept Jesus, repent of your sins and begin living a life for Christ and you will see Him in Heaven. 

The second passage, which really spoke to me, is Psalms 15: 1-5.   Jesus speaks through David and tells us who may abide with Him.  

“O lord, who may abide in Your tent?  Who may dwell on Your holy hill?  He who walks with integrity, and works righteousness, and speaks truth in his heart.  He does not slander with his tongue, nor does evil to his neighbor, Nor takes up a reproach against his friend; in whose eyes a reprobate is despised, but who honors those who fear the Lord; he swears to his won hurt and does not change; he does not put out his money at interest, Nor does he take a bribe against the innocent. He who does these things will never be shaken”

WOW!  This passage packs a punch!  Jesus tells me both how to act and how not to act in these five verses.   I read this passage in 11^th grade and God used it to convict my heart years later. 

            I just realized how long this post is becoming.  So, I think I will close with a simple definition of “hate” and “love”.   The word “hate” denotes a “turning away from”. The word “love” denotes a “turning toward”.    With these two definitions in mind, I will summarize my answer to how I can “hate the sin and love the sinner.” 

            I try to turn away from any act, thought, or deed, which is contrary to God’s laws, and try not to engage in the act of sinning.   I am not saying I am perfect- rather I am turning away from the path the sin may take me- Proverbs 4:13.   As I turn away from the sin, I am turning toward God.  I am looking to follow Him – His teachings, His laws. I am seeking His will for my life- what does He want me to do rather than what do I want to do.  He clearly teaches all throughout His ministry on earth that we are to hate the sin but love the sinner.  He tells us this very simply in Matthew 5:43-44 “You have heard that is was said, ‘You shall love your neighbor and hate your enemy.  But I say to you, love your enemies, and pray for those who persecute you.”   He goes on to say in His same sermon (the Sermon on the Mount) that if we are angry against another then we are also sinning and are just as guiltily as murderers are.  He goes on to teach us too what the public school system knows as the Golden Rule: “Do unto others as you would have them do unto you.”  

All these teachings and more (even Old Testament law handed down from God such as the 10 Commandments and teachings from God to His people as such can be found in Leviticus 19:17 “You shall not hate your fellow man in your heart, you may surely reprove your neighbor, but shall not incur sin because of him.  You shall not take vengeance, nor bear any grudge against the sons of your people but you shall love your neighbor as yourself; I am the Lord.”)  tell me to hate the sin because sin is “an abomination to the Lord” and to love the sinner because we are to display the characteristics that Jesus taught us as He was living on this earth and what God has taught us from the beginning of time.

I am comforted by your thoughts and prayers.  I enjoy reading your letters of encouragement as well as the Bible verses you send me.  Some of you have asked me for an update. Many events have occurred since my last prayer letter to you.  The following is an update:

UPDATE         

1. Janet filed with the court this week an additional document – her proposed order of custody and visitation. In this document, which is seven pages, she claims that she should have sole physical and legal custody of Isabella.  She writes that she should have all and final rights over Isabella’s “religion”.  Janet goes on to detail a visitation schedule for me including time when I may phone my daughter as she is living in
   Vermont with Janet as her “mom.”   I may call my daughter only two days per week and it must be at 7:00p.m.  Furthermore, if I should have visitation with my daughter then I am to report in to Janet after 24 hours informing  Janet where I am – including giving her my land line telephone numbers and the  address where I am visiting/staying.   This seven-page document is difficult to read.  I have posted it in its entirely on my blog (please see below for that update).
2. The Virginia Supreme Court denied our appeal and cited filing discrepancies.  We have another appeal to this court.  At this time, it is undecided as to what this court will do with this appeal. 
3. The U.S. Supreme Court rejected our second appeal stating that it is too premature for them to take that appeal.  
4. Today:  Janet filed sanctions in the Vermont Family Court against me claiming that I cancelled a planned visitation between Janet and Isabella.  She claims that I agreed to a visit on May 12, 2007 and that she has had to cancel travel plans. She is asking the court for fines to be levied against me as well as a record that I am not obeying the temporary order of the original Vermont custody order dated 2004.   We are in the process of replying to that sanction filing for I did not agree to a visit between Janet and Isabella for May 12, 2007.  I had already had plans for the entire weekend. We informed Janet’s attorneys that we did not agree to the visit date and we offered another time for a visit. We offered May 5, 2007.   She accepted and I found a “third party” to accompany us.  However, on May 2, 2007 I was informed that Janet could not make that visit due to travel arrangements.   We then agreed to another visit which is scheduled for May 26, 2007. This visit will also be supervised as the last visit was supervised.  

NEW: 

I have been lead by the Lord to start a blog.   The blog however is not a typical blog. Rather, its sole purpose is to inform the public about my legal case.  It will have my testimony (this will be posted in the next several days), the answer to the question which I get asked a lot (How do you continue and how do survive knowing that your daughter can be taken away from you?) and it has information regarding prayer letters and general letters that I share with the public, a section for the briefs that Janet filed and other bits of information regarding the religious persecution that Janet is levying on Isabella and I (part of her 22 page facts and findings will be included in the section “Legalize”) as well as other topic pertinent to my legal case.  Janet’s proposed custody order where she is asking for sole custody is already posted.  Should you need help in navigating the blog please click on “Navigational Help” which can be found on the top of the page. 

 I have been silent for these 3.5 years with the exception of several interviews that I have granted.   I am silent no more.  God has been so sovereign and so gracious to me these past years. It is now time to share with the world what He has done:  Mark 5:19 “And He did not let him (talking about the healed demon possessed man going with Jesus in the boat), but He said to him, “Go home to your people and report to them what great things the Lord has done for you, and how He had mercy on you.”  God alone is control and God alone has granted and given the protection that has happened thus far. I know that our Lord wants EVERYONE to know- especially Christians- what is happening in the state of
Virginia.  No one is safe from religious persecution.  No one will be safe under their state laws should Virginia’s final rule be in Janet’s/

Finally, my friends please continue to pray.  The
Vermont ruling is still pending.  Please pray for total victory for Isabella- sole custody including religion decisions to be placed under my guidance and for no visitation for Janet.  Please continue to pray for Judge Cohen.  Our God is powerful.  Our God has knowledge. I put my trust in Him.  Please pray Matthew 7:7-8 and please read Psalms 37.  Please keep me in your prayers as I continue to stand for our Lord.

This document is difficult to read due to the emotional nature of what Janet is asking for.  This document was approved by Janet and sent by her lawyers to the Rutland Family Court in Vermont. In it Janet asks for full legal and physical custody of my daughter, including all religious determinations.
